When the Dark Lord first rose to power taking an army and naming them "Death Eaters" the White Wizard Dumbledore rallied alias of his own and threw him down. Voldemort's followers scattered to the winds only to be seen fleeting down a dark alley and heard of only in trembling whispers. After a time peace was re-instilled in the Wizarding World and hope flourished. After years of cessation a dark wind began to blow and the Death Eaters began to gather, Lord Voldemort had returned.
It was during this time of vulnerability that the Dark Wizard lead many synchronized and devastating attacks against the most vulnerable and unforgivable of targets, in addition to the ministry the Death Eaters assaulted Muggles openly, as well as many wizarding schools, including Hogwarts, where the youth of the Magical world were taught. Dumbledore who was the headmaster of Hogwarts school stood in opposition alone against his former pupil and those that followed him until other like minded witches and wizards arrived to help fortify school and save the students who remained or desperately fled for their lives.
In the wake of the battle both Dumbledore and Voldemort had been defeated and mingled blood with the other fallen warriors and youth. The castle was left in ruins and abandoned for many years fearful parents taking it upon themselves to teach their children in secrecy.
Over the next decade the Death Eaters began to rise once more, but this time without their dark and vile leader they began playing a game of subterfuge rather than the roles of full on warriors. To achieve their goals they began taking positions within the ministry and other places of power throughout the wizarding world. Quickly did the Death Eaters integrate themselves into their new roles living mundane lives it is now almost impossible to tell where an individual's alliances lie.
By this time however, those who had sided with Albus Dumbledore found themselves together and with the nerve and desire to restore Hogwarts and the power to the light; coming to call themselves The Order of the Phoenix for like the great and fiery bird they would rise again out of the ashes, as would the once magnificent school.
During the first year of school resuming function students of all ages were accepted, and the Order Members set about making rigorous fail-safes to defend the children including grand fireplaces with floo powder on every floor should a third wizarding war begin, not knowing that to the Death Eaters the war had never ended.

Side notes:
As you doubtlessly noticed this is an AU or Alternate Universe version of Harry Potter. This is not because we don't appreciate or enjoy the Harry Potter storyline, but because we all know it and it would be boring and redundant to try to put yourself into a chess game that's already been won.
In this AU the only cannon characters to exist are Voldemort and Dumbledore giving us the classic good vs evil set up, but the deciding factors, the warriors and truth seekers are not Harry, Ron, Hermione, Snape and everyone we know and love; the people who can really change this world are each of you!
You don't need to choose a side right away or at all, you can be neutral or even indifferent. You may become or cease being a Death Eater at any time, be forewarned doing either will change the way some people see you. The Order allows for only adults, but the children have begun their own alligance calling themselves Dumbledore's Army after the great wizard who died in the defense of the school and children like themselves, students may join this at any time.
There can and likely will be spies who have infiltrated either side, I will likely limit these if the spies begin to out number the true members. There are two types of spies those who gather information when and where they can, and those who pose as the enemy, if you wish to be the latter contact me and I will arrange it. (You'll see!)
For the very beginning students are allowed to be of any age, but the next in game year all new students will be 11 year old first years. In addition many schools such as Durmstrang and Beauxbatons were decimated, so feel free to have multi cultured or foreign original characters who are coming to Hogwarts as they have no where else to study or learn.
Death Eaters are allowed to be anything including working at the school. With regards to the school however, this is as long as the Death Eater in question keeps their loyalties hidden because the school is overseen by The Order. Despite the risk however, holding a position within the school can prove of much worth to the Death Eater's cause.
There's still a war on but it's (for now) is a strategic war, full of secret meetings, sabotage, spies and random strikes and raids.
And to quote Sirius Black, this is the general atmosphere of the RP: "Imagine that Voldemort's powerful now. You don't know who his supporters are, you don't know who's working for him and who isn't; you know he can control people so that they do terrible things without being able to stop themselves. You're scared for yourself, and your family, and your friends. Every week, news comes of more deaths, more disappearances, more torturing… The Ministry of Magic's in disarray, they don't know what to do, they're trying to keep everything hidden from the Muggles, but meanwhile, Muggles are dying too. Terror everywhere… panic… confusion…"
